How much should an access parent pay toward hockey or swimming or tennis for his child?
Should he pay at all? These are vexing questions under Section 7 of the Child Support
Guideline in each province and with each judge.
The issue of Section 7 expenses is an area of Family Law that has led to disparate
results in the determination of what constitutes a "special" or "extraordinary" expense.
To assist in bringing some consistency to this area, Mr. John Syrtash has developed and
launched a new database for S.7 expenses. The database will permit
parents or lawyers to compare their individual fact situation to all cases ever
decided under the section. Regardless of whether a subjective or objective approach is
followed, lawyers from across Canada will be able to review the decisions on the different
activities that have been claimed under the section since the implementation of the
Guidelines 1997 and see where their particular case "fits in". The Section 7
Extraordinary Expense Database will permit lawyers or parents to compare and contrast the
facts of their circumstances with decisions pursuant to S. 7. In addition to providing
information with respect to the type or number of S.7 activity expenses as claimed, the
Section 7 Extraordinary Expense Database is set up such that cases can be also tracked with
reference to the Province, judge, or income levels of the parties.
